"Supreme Court terms Madhya Pradesh High Court's order on admission process as contrary to judicial propriety"


The Supreme Court has recently observed that the Madhya Pradesh High Court passed an interim order to allow state colleges to participate in the admission process, which was similar to the one stayed by the apex court last year and said that the said practice does not conform to judicial propriety. A bench of Justices BR Gavai and KV Vishwanathan said that despite a specific order passed by the apex court staying the interim order for the previous academic year 2023-24, the Madhya Pradesh High Court again passed a similar order for the current academic year 2024-25. "We are of the view that the said practice does not conform to judicial propriety. When an interim order was passed by this Court for the previous year, the High Court should have given due importance to it," the apex court said. Senior counsel for the appellant DS Naidu submitted that the court is likely to set aside the impugned order. He further said that as per the interim order passed by the High Court, the appellants have not admitted any student for the academic year 2024-25.

The impugned order is therefore set aside and the appeal is allowed, the apex court ordered, and added that the matter is remanded back to the High Court for fresh consideration. The apex court has vide order dated December 8, 2023, stayed the order dated November 23, 2023 of the Madhya Pradesh High Court, wherein a college was provisionally permitted to participate in the ongoing counselling for admission to sixty seats in the BAMS degree course for 2023-2024. The apex court said that despite several orders passed by it condemning the practice by High Courts in permitting colleges to participate in the admission process by interim order, the High Court has again passed an interim order permitting a college to participate in the admission process. The Madhya Pradesh High Court will hear the matter on October 14, 2024. The apex court clarified that the high court will decide the petition on its merits without being influenced by the present order.
